Software is a valuable intellectual property asset, and protecting it under copyright law is crucial to prevent unauthorized use, reproduction, or distribution. In Kenya, software is recognized as a literary work under the Copyright Act, granting developers exclusive rights over their creations.
Understanding Software Copyright in Kenya
Software is protected internationally under the Berne Convention, TRIPs Agreement, and WIPO Copyright Treaty. Similarly, in Kenya, the Copyright Act recognizes software as a computer program, defined as a set of instructions that directs a computer’s operations.
To qualify for copyright protection, software must:
- Be original and demonstrate creative effort.
- Be fixed in a tangible form (e.g., written code or recorded data).
- Not be a mere idea but an executable program.
Copyright grants economic rights (such as reproduction, distribution, and adaptation) and moral rights (such as attribution and protection against distortion). The Kenya Copyright Board (KECOBO) facilitates copyright registration through the National Rights Registry (NRR) portal.
