WHAT HAPPENS TO YOUR LOVED ONE’S PROPERTY WHEN THEY DIE?

1. Losing a Loved One is a painful and tragic experience. It can be even more painful when you don’t know how to share the property they left behind and a dispute arises. What should you do?

2. If the Loved One left a Will, you as a close family member listed as the Will’s Executor can apply for a Grant of Probate. This will give you the power to transfer or sell their property in accordance with the Will.

3. To get a Grant of Probate, you will need a number of documents including a Petition, a Letter from your local Chief confirming your relationship to the Deceased and an Affidavit. You can get a Lawyer to help you prepare the Documents.

4. If they died without a Will, you will apply for a Grant of Letters of Administration which will give you the Power to Transfer or Sell their Property.

5. If you have urgent needs like School Fees or Hospital Bills,  you can get a Special Grant that will give you the power to access their Bank and Mpesa Accounts to Withdraw the money you need.  The Special Grant can also give you the Power to Sell their Property to pay the fees or hospital bills.

6. Once you get either Grant, you will be able to access their Bank Account, Mpesa Account and have the Power to Transfer or Sell their Property
